In his ruling, Superior Court Judge Alexander H. Carver III validated the right of the zoning board to grant a height variance for the LG headquarters project at 111 Sylvan Ave. The judgment covered two actions which involve multiple plaintiffs against the Zoning Board of Adjustment and LG Electronics USA.
This is a significant step forward for LG Electronics, which can now begin work on its $300 million project. In a statement, LG called the ruling "great news for the company and its employees, and especially for the local community because of the enormous economic benefits that this world-class green building will bring to Englewood Cliffs, Bergen County and the State of New Jersey."
Wayne Park, President and CEO of LG Electronics USA, said, "As we have constantly reminded people over recent months, LG was transparent, accountable and consultative in the process to achieve all necessary approvals for this project. We listened carefully to the concerns of local residents and community groups, and we amended our plans to address those concerns. Judge Carver's judgment underscores the fact that Englewood Cliffs and LG Electronics followed the proper approval process for the project," he said.
The court ruling sets the stage for construction to begin shortly. In fact, the company is taking the first steps on the construction project, preparing for the demolition of the existing buildings at 111 Sylvan Ave.
In March 2012, two local plaintiffs, Carol Jacoby and Marcia Davis, filed case numbers BER-L-2301-12 and BER-L-2372-12 in New Jersey Superior Court claiming, among other things, that the Englewood Cliffs Zoning Board of Adjustments exceeded its authority in granting approval for the LG project.
In January 2013, Judge Carver allowed Interveners into the case only for the purpose of appeal. Joining the case at the urging of New York special interest groups, the Interveners were the New Jersey State Federation of Women's Clubs, Scenic Hudson Inc. and two individuals, Margo Moss and Jakob Franke, members of the NY-NJ Trail Conference.
