DALLAS, March 29, 2014 /PRNewswire/ -- Deans & Lyons, LLP, a Texas-based litigation boutique, has filed suit against several defendants, including Baylor Health Care System and Christopher Duntsch, a neurosurgeon. The lawsuit, filed on behalf of Barry Morguloff, alleges Mr. Morguloff has sustained permanent, severe personal injuries as a result of "what can only be described as one of the most prolific mass torts involving medical malpractice in Texas history." Duntsch's license to practice medicine in Texas was suspended by the Texas Medical Board in June of 2013 following complaints made by fellow physicians after the deaths of two patients and multiple patients who suffered permanent paralysis or other severe injuries following surgeries performed by Duntsch.
The Morguloff lawsuit alleges Duntsch not only placed spinal fusion hardware incorrectly, but also damaged bone in Mr. Morguloff's spine, releasing bone fragments which ultimately caused severe, permanent nerve damage leaving Mr. Morguloff in constant pain.
According to the Morguloff lawsuit, numerous patients have been killed or maimed by Duntsch. The suit further alleges that Baylor Health Care System knew of serious allegations involving Duntsch's competency to operate and nevertheless permitted him to continue operating. The lawsuit includes a letter of recommendation provided by Baylor Medical Center of Plano following surgeries where one patient was rendered a quadriplegic and another patient died under Duntsch's care. The letter permitted Duntsch to obtain temporary privileges at another Dallas area hospital where Duntsch allegedly killed and maimed other patients. The lawsuit also alleges that Baylor Health Care System failed to report Duntsch to the National Practitioners Data Bank and the Texas Medical Board, allowing Duntsch to continue to seriously injure or kill patients.
