The Company is not eligible for a second 180-day period because it does not comply with the minimum stockholders' equity requirement for initial listing on The Nasdaq Capital Market. The Nasdaq Hearings Panel will consider this matter in rendering a determination regarding the Company's continued listing on The Nasdaq Capital Market at an upcoming hearing which will also consider the Company's non-compliance with the $2.5 million stockholders' equity requirement set forth in Nasdaq Listing Rule 5550(b)(1).
